AZ HCR2016

Amends section 1-502 to exclude postsecondary education from the definition of "state or local public benefits" requiring documentation of lawful presence in the United States.

Repeals the prohibition in section 15-1825 that prevented undocumented students from being classified as in-state students.

Allows persons regardless of immigration status to be classified as in-state students and county residents if they entered Arizona as minors, meet residency requirements, are eligible for admission, and have no prior felony convictions.

Entitles qualifying students to the same rights and benefits as other in-state students, including eligibility for financial aid and scholarships.

Requires universities and community colleges to keep confidential any information submitted by students under this act and directs the Secretary of State to submit the measure to voters at the next general election.
