SB 1148 Summary

• Amends Arizona Revised Statutes Section 13-3102 to add a new mandatory sentencing provision for persons convicted of using or possessing a deadly weapon during the commission of any felony offense included in chapter 34 of the Arizona Criminal Code.

• Persons convicted under this provision shall not be eligible for suspension of sentence, probation, pardon, or release from confinement except as authorized by section 31-233 subsections A or B, or until sentence is served or commuted.

• Any sentence imposed under this provision shall run consecutively to any other sentence imposed for a violation of chapter 34 committed on the same occasion.

• The mandatory sentencing provision does not apply if the offense involves personal possession or use of a controlled substance.

• Maintains existing felony and misdemeanor classifications for various types of misconduct involving weapons offenses.
