• Prohibits counties, municipalities, and political subdivisions from adopting or enforcing local laws that criminalize being a common drunkard or being found in an intoxicated condition.

• Exempts laws related to drunken driving, driving under the influence, and operation of vehicles, aircraft, boats, machinery or equipment from the prohibition.

• Allows municipalities that operate or contract with county-owned detention facilities to enact ordinances prohibiting public intoxication when a person poses a danger to themselves or others.

• Prevents local governments from interpreting or applying general laws in ways that circumvent the restrictions on criminalizing intoxication.
