Limits annual fee increases for homeowners' association resale disclosure services to 3% per year beginning January 1, 2013, down from the previous 20% annual increase cap.

Applies the 3% annual increase cap to both condominiums (A.R.S. § 33-1260) and planned communities (A.R.S. § 33-1806).

Maintains the maximum aggregate fee for resale disclosure, lien estoppel, and related services at $400, plus separate rush fees ($100) and update fees ($50).

Clarifies that trustees conducting trustee's sales under deed of trust are excluded from the definition of "unit owner" and "member" subject to these disclosure requirements.
