HB 2274 Summary

• Requires homeowners' associations for condominiums (regulated under title 33, chapter 9) and planned communities (regulated under title 33, chapter 16) to register with the Arizona Secretary of State beginning January 1, 2015, instead of recording notices in county recorder offices.

• Associations must provide the Secretary of State with: association name and contact information, address, telephone number, number of units, cross streets of location, and year the community was established.

• Secretary of State shall post all registered homeowners' association information on its website in a publicly accessible format beginning March 1, 2015.

• Associations must update their registration information with the Secretary of State within 90 days of any changes to the required information.

• Secretary of State shall contract with a nonprofit corporation to establish and maintain the registry, with the initial contract term of three years and optional renewal for five years; contract provider may charge a fee for the registry service.
