Court must place defendants convicted of drug possession or paraphernalia charges on probation if evidence was obtained during a drug-related overdose or while seeking medical assistance for someone overdosing.

Section 13-901.01, subsection H, paragraph 4 restrictions do not apply to individuals who qualify for probation under this statute.

Defendants who successfully complete probation under this provision shall have their conviction automatically set aside under section 13-907.
