HB 2377 Summary

• Expands the definition of "prohibited possessor" to include persons hospitalized for evaluation, care, and treatment under section 36-518, whose right to possess firearms has not been restored.

• Allows persons involuntarily hospitalized under section 36-518 to petition the court where they currently reside to restore their firearm rights, in addition to existing petition procedures for other prohibited possessors.

• Requires courts to consider whether circumstances leading to hospitalization remain in effect when evaluating petitions for firearm rights restoration.

• Mandates the Department of Public Safety notify the U.S. Attorney General within ten business days when a court grants a petition restoring firearm rights to a person previously hospitalized under section 36-518.
