HCR 2032 Summary

• Enacts a measure for voter approval that establishes smoking prohibitions in elevators, theaters, libraries, buses, health care facilities, and offices of medical professionals.

• Classifies violations of smoking prohibitions as petty offenses, with exceptions allowing designated smoking areas in certain locations.

• Prohibits smoking in buildings owned or directly leased by the state, except for inmates in correctional facilities, patients at Arizona State Hospital, residents of state facilities, and those using tobacco for religious/ceremonial purposes.

• Requires the Department of Administration to establish procedures for containing smoke drift in state buildings and to allow anonymous employee complaints regarding violations.

• Repeals existing sections 36-601.01 and 42-3251.02 of Arizona Revised Statutes and submits the new measure to voters at the next general election.
