Amends the definition of "eligible person" for Arizona's Health Care Cost Containment System (AHCCCS) to include persons with income between zero and 133% of federal poverty guidelines, with resource limits no less restrictive than those in effect on November 5, 1996.

Allows the people through initiative or the legislature by simple majority vote to expand eligibility to even higher percentages of the federal poverty guidelines.

Prohibits the executive department and legislature from establishing a cap on the number of eligible persons who may enroll in AHCCCS.

Requires funding for benefits to eligible persons to come from the Arizona tobacco litigation settlement fund, supplemented by other available sources including legislative appropriations and federal monies.

Grants eligible and prospective eligible persons the right to sue the AHCCCS director and the state in superior court to enforce these provisions, with courts authorized to apply civil sanctions and equitable remedies.
