Court shall place persons convicted of personal drug possession or paraphernalia possession on probation if the evidence resulted from the person experiencing a drug-related overdose and needing medical assistance.

Court shall place persons convicted of personal drug possession or paraphernalia possession on probation if the evidence resulted from the person seeking medical assistance in good faith for another person experiencing a drug-related overdose.

Section 13-901.01, subsection H, paragraph 4 does not apply to persons otherwise eligible for probation under this section.

Upon successful completion of probation, the court shall automatically set aside the judgment of guilt pursuant to section 13-907.
