SB 1300 Summary

• Requires motor vehicle drivers to maintain a safe distance of at least three feet when overtaking and passing bicycles in the same direction.

• Establishes civil penalties of up to $500 for violations resulting in serious physical injury and up to $1,000 for violations resulting in death.

• Exempts violations from civil penalties if a bicyclist is injured while riding in a vehicular traffic lane when a designated bicycle lane or path is available and passable.

• Removes the exemption if the motor vehicle driver was driving in reckless disregard for safety or if the bicyclist was in the traffic lane to pass another bicyclist or make a left turn.
