SB 1307 Summary

• Law enforcement must inquire within three hours of arrest whether a person is a custodial parent with responsibility for a minor child and notify them of their rights.

• Arrested custodial parents are entitled to make two completed telephone calls to arrange child care at no cost if calling within the local calling area, or at their own expense for calls outside the local area.

• Law enforcement agencies must post conspicuous signs in English and other languages spoken by significant portions of their service population informing arrested persons of their right to make child care arrangement calls.

• This section does not limit law enforcement officers' existing obligations to advise suspects of their right to counsel or other statutory rights.

• Violation of this section by a public officer or employee knowingly depriving an arrested person of these rights is classified as a class 3 misdemeanor.
