HB 2030 Summary

• Establishes a drug screening and testing program for unemployment benefit claimants in occupations that regularly require drug testing as designated by federal labor department regulations.

• Requires individuals filing initial claims to complete a written drug screening questionnaire; those showing reasonable likelihood of drug use must submit to and pay for a drug test administered by the department.

• Disqualifies individuals who fail drug tests from receiving benefits until passing a subsequent test at least four weeks later, with exceptions for those in drug abuse treatment programs or using prescribed medications.

• Provides claimants 14 days after notice of failure to appeal and retake the test, with the determination becoming final either 15 days after notice if no appeal is filed or upon confirmation of positive results on retest.

• Sunsets the program on July 1, 2024, and applies to unemployment benefit claims filed with the department after December 31, 2014.
