Court shall place persons convicted of personal possession or use of controlled substances on probation if evidence resulted from seeking medical assistance for a drug-related overdose.

Applies when the person was themselves experiencing overdose and needed medical assistance, or when seeking help in good faith for another person experiencing overdose.

Section 13-901.01, subsection H, paragraph 4 does not apply to persons eligible for probation under this section.

Court shall automatically set aside the judgment of guilt upon successful completion of probation under this section.
