HB 2376 Summary

• Prohibits drivers from using handheld wireless communication devices to manually write, send, or read written messages while operating a motor vehicle.

• Exempts authorized emergency vehicle operators, law enforcement officers performing duties, people dialing phone numbers for calls, and drivers whose vehicles are not in motion.

• Classifies violations as nonmoving civil traffic violations with a $50 penalty if no motor vehicle accident is involved, or $200 penalty if an accident occurs.

• Establishes a one-month warning period from January 1, 2015 through January 31, 2015, during which law enforcement may only issue warnings for violations.

• Takes effect December 31, 2014.
