Prohibits agencies from adopting new rules that increase regulatory burdens on property rights or lawful business unless the rule reduces overall regulatory restraints or is strictly ministerial in implementing clear legislative standards.

Provides a defense for any person subject to civil or criminal enforcement of a rule that violates the restrictions in subsection A.

Courts reviewing the defense must rule on its merits without deference to legislative, administrative, or executive findings about the rule.

Allows courts to award attorney fees and costs to the prevailing party, other than the agency, in enforcement actions involving the defense.
