Allows private business owners to recover compensation for business losses resulting from public construction projects lasting more than 10 months or that permanently reduce business activity.

Owners may recover up to three years of losses and must initiate proceedings by serving the public entity with a notice of claim by certified mail within 60 days after the 10-month loss period ends or within 60 days after construction completion.

Owners bear the burden of proof in administrative or judicial proceedings to demonstrate that public construction caused business losses and to establish the amount of compensation owed.

Exempts public construction undertaken to prevent tangible harm to public health and safety or address grave and immediate threats to life or property from the compensation requirements.
