HB 2641 Summary

• Amends Arizona law to broaden the definition of "tobacco product" to include electronic smoking devices and any product containing nicotine intended for human consumption, whether smoked, heated, chewed, absorbed, dissolved, inhaled or ingested.

• Changes the penalty for selling tobacco products to minors from a petty offense to a class 2 misdemeanor.

• Prohibits electronic smoking devices on school grounds, inside school buildings, in school parking lots or playing fields, in school buses or vehicles, or at off-campus school sponsored events.

• Allows business owners to prohibit the use of electronic smoking devices by any person on their premises.

• Excludes products specifically approved by the FDA for tobacco cessation from the definition of electronic smoking devices and tobacco products.
