SB 1043 Summary

• Amends Arizona's pharmacy and naturopathic medicine laws to add fingerprinting requirements for initial pharmacy license applicants and authorize criminal records checks through the Department of Public Safety and FBI.

• Allows naturopathic physicians to prescribe drugs that are reclassified from Schedule III to Schedule II controlled substances after January 1, 2014, in addition to their existing authority over morphine.

• Updates pharmacy registration requirements to include applications for out-of-state pharmacies, drug manufacturing facilities, and wholesaling facilities that dispense or distribute drugs into Arizona.

• Clarifies generic drug substitution rules by removing the requirement for the board to maintain a prohibited drug list and establishing definitions for brand name drugs, generically equivalent drugs, and formularies.

• Makes technical corrections to legend drug product requirements by removing provisions on board rule implementation and clarifying exemption procedures for drugs where code imprinting is impractical.
