Prohibits operating a motor vehicle on a highway while using a wireless communication device to send or receive a written message.

Exempts law enforcement and safety personnel performing official duties, and drivers of authorized emergency vehicles performing official duties.

Classifies violation as a nonmoving civil traffic violation with first offense penalty of $100, second or subsequent offense penalty of $300.

Increases penalty to $500 if violation occurs during a motor vehicle accident, or $10,000 if the accident results in death of another person.

Requires law enforcement officers to document on accident reports when a driver cited for this violation was using a wireless communication device at the time of the accident.
