SB 1299 Summary

• Repeals Title 11, Chapter 7, Article 8 (gang and immigration intelligence team enforcement mission) and sections 13-1509, 13-2928, 13-2929, and 41-1724 of Arizona Revised Statutes.

• Removes the provision allowing peace officers to arrest persons without a warrant for committing any public offense that makes them removable from the United States (section 13-3883).

• Repeals the requirement in section 28-3511 to remove and immobilize vehicles used to transport undocumented aliens or to conceal and harbor undocumented aliens.

• Removes entrapment defense provisions from sections 23-212 and 23-212.01 relating to employer violations for knowingly or intentionally employing unauthorized aliens.

• Amends section 12-116.04 to eliminate funding allocation to the gang and immigration intelligence team enforcement mission border security and law enforcement subaccount, redirecting those funds to the public safety equipment fund.
