HB2369 Summary

• Requires death certificate preparers to record the decedent's sex based on gender identity, reported by the person completing the certificate unless documentation of gender transition is presented.

• Allows amendment of registered death certificates to reflect gender identity when presented with documents memorializing gender transition, including court orders, written instructions, health care directives, clinical treatment records, or changes to birth certificate, driver license, Social Security, or passport.

• If no gender transition documentation is provided and the person(s) with legal right to control disposition of remains disagrees with the reported gender identity, the death certificate shall reflect the gender identity reported by that person or majority of persons controlling disposition.

• Makes conforming changes to subsection lettering and numbering throughout section 36-325 to accommodate new provisions regarding gender identity on death certificates.
