HB 2387 Summary

• Repeals Title 11, Chapter 7, Article 8 and sections 13-1509, 13-2928, 13-2929, and 41-1724 of Arizona Revised Statutes, eliminating various immigration-related enforcement provisions.

• Removes the requirement that peace officers may stop any person operating a motor vehicle based on reasonable suspicion of civil traffic violations in connection with human smuggling investigations.

• Eliminates the ability of peace officers to arrest a person based on commission of any public offense that makes the person removable from the United States.

• Removes provisions authorizing vehicle impoundment when a person is transporting or concealing unauthorized aliens in furtherance of illegal presence in the United States.

• Eliminates the entrapment defense for employers in unauthorized alien employment violations and removes the Gang and Immigration Intelligence Team Enforcement Mission Border Security subaccount, redirecting those funds to the public safety equipment fund.
