Courts must place individuals convicted of personal drug possession or drug paraphernalia possession on probation if evidence was obtained during a drug overdose emergency or while seeking medical assistance for someone experiencing an overdose.

The probation requirement applies regardless of whether the person was experiencing the overdose themselves or was in good faith seeking medical help for another person who needed assistance.

Section 13-901.01, subsection H, paragraph 4 restrictions do not apply to individuals eligible for probation under this statute.

Upon successful completion of probation, the court shall automatically set aside the judgment of guilt according to section 13-907.
