Pet stores and pet dealers are prohibited from selling dogs unless obtained from animal shelters, private nonprofit humane societies, or qualifying breeders who have not received more than two USDA citations for animal welfare violations within two years or two consecutive citations for facility access violations.

Commercial dog breeders must be licensed by the United States Department of Agriculture to sell dogs to pet stores or pet dealers.

Pet stores and pet dealers must maintain records for at least two years verifying compliance with these requirements.

Violating these prohibitions constitutes a class 1 misdemeanor for each dog sold or offered for sale.
