AZ HCR2009

Requires all firearm sales or transfers to be conducted through a licensed firearms dealer, with limited exceptions for law enforcement, military, family gifts, and specific other circumstances.

Mandates background checks on firearm purchasers or transferees pursuant to federal law (18 USC § 922(t)) and state law before a dealer can deliver the firearm.

Allows licensed dealers to charge up to $20 in administrative fees to cover costs of facilitating transfers between non-dealers.

Establishes exemptions from the dealer requirement including transfers to immediate family members (spouses, parents, children, siblings, grandparents, grandchildren, nieces, nephews, first cousins, aunts, uncles), temporary transfers to prevent imminent death or bodily harm, and transfers of antique firearms.

Classifies violations of the requirement as a class 5 felony and directs submission of the measure to voters at the next general election.
