Court shall place a person convicted of personal possession or use of a controlled substance on probation if the evidence was obtained while the person was seeking medical assistance for their own drug-related overdose.

Court shall place a person convicted of personal possession or use of a controlled substance on probation if the evidence was obtained while the person was in good faith seeking medical assistance for another person experiencing a drug-related overdose.

Section 13-901.01, subsection H, paragraph 4 does not apply to persons eligible for probation under this section, exempting them from certain probation restrictions.

Upon successful completion of probation, the court shall automatically set aside the judgment of guilt pursuant to section 13-907, effectively clearing the conviction.
