Criminal trespass in the first degree related to critical public service facilities (paragraph 6) is classified as a class 5 felony.

Criminal trespass in the first degree related to residential structures or religious property desecration (paragraphs 1 and 5) is classified as a class 6 felony.

Criminal trespass in the first degree related to fenced residential yards, peeping into residential structures, or unlawful entry on mineral claim property (paragraphs 2, 3, and 4) remains classified as a class 1 misdemeanor.
