Requires school districts and charter schools that offer kindergarten to provide full-day kindergarten instruction as an option to parents, replacing the current "may offer" language with mandatory provision.

Allows parents to choose either half-day or full-day kindergarten instruction for their eligible children.

Permits school districts and charter schools to use the same curriculum for both half-day and full-day programs without requiring separate curricula.

Makes the bill's effectiveness conditional on resolution of the Cave Creek Unified School District v. Ducey lawsuit (CV2010-017113) through final court judgment or binding settlement.

Implementation is required in the next school year after the lawsuit condition is met, with schools encouraged to use inflation funding from the lawsuit resolution to pay for additional instruction.
