SB 1229 Summary

• Repeals Title 11, Chapter 7, Article 8 of Arizona Revised Statutes (gang and immigration intelligence team enforcement mission provisions) and section 41-1724 related to border security funding.

• Removes provisions allowing law enforcement to stop vehicles based on reasonable suspicion of civil traffic violations in smuggling cases and eliminates arrest authority for crimes making persons removable from the United States.

• Repeals sections 13-1509, 13-2928, and 13-2929 of Arizona Revised Statutes and removes entrapment defense provisions from employment-related unauthorized alien statutes (sections 23-212 and 23-212.01).

• Eliminates vehicle removal and impoundment provisions related to transporting, harboring, or concealing unauthorized aliens in violation of federal law (section 28-3511).

• Modifies penalty assessment fund distribution by redirecting money previously allocated to gang and immigration intelligence operations to the public safety equipment fund, and removes record retention requirements for e-verify employment verification (section 23-214).
