SB 1326 Summary

• Law enforcement agencies must immediately seal arrest records when they determine a person was wrongfully and incorrectly arrested and is factually innocent of the charges.

• Agencies must retract any information they previously disseminated or reported to other persons or entities regarding the wrongful arrest.

• Law enforcement agencies must notify the arrested person that their record has been sealed and that they may deny the arrest ever occurred.

• A person with a sealed arrest record may deny the arrest happened in all circumstances, including job applications (law enforcement and school-related), concealed weapons permits, state bar membership, public office candidacy, and firearm purchases.
