HB 2007 Summary

• Reduces possession of less than one ounce of marijuana from a class 6 felony to a civil penalty of up to $100, increasing to $200 if unpaid within 90 days.

• Changes penalties for marijuana possession of one to two ounces from class 5 felony to a petty offense, and possession of two or more pounds from class 4 felony to class 3 misdemeanor.

• Requires juveniles adjudicated delinquent for first marijuana possession violations to complete at least ten hours of community restitution with drug counseling or treatment agencies instead of felony conviction.

• Modifies sentencing provisions in section 13-3419 to exclude certain marijuana possession offenders from mandatory minimum sentences and allow probation eligibility.

• Allows prisoners previously convicted of or found responsible for marijuana possession to be eligible for parole or community supervision if they have no prior violent crime convictions.
