All school districts must provide sex education in kindergarten through grade 12 that is medically accurate, developmentally accurate, and age-appropriate, with instruction on laws relating to sexual conduct with a minor for grades 7-12.

Sex education instruction must cover delaying sexual activity, contraceptive and barrier method use, healthy relationship skills, physical and emotional changes of adolescence, critical thinking about sexuality, and encouragement of communication with parents and trusted adults.

Parents must provide written permission for their child to opt out of sex education curricula; students cannot face disciplinary action, academic penalties, or sanctions for non-participation.

School districts must make sex education curricula available for parental review, and the Department of Education must develop a list of compliant curricula, designate instructor qualifications, and receive biennial district reports on curricula used.

Sex education instruction may not discriminate based on sex, race, ethnicity, national origin, disability, religion, sexual orientation, or gender identity; parents and students can file complaints with the Department of Education or pursue legal action for non-compliance.
