Director of the Department of Environmental Quality shall apply to the U.S. Environmental Protection Agency for a waiver from state implementation plan requirements regarding Arizona clean burning gasoline and Arizona reformulated blendstock for oxygenate blending.

The waiver would permit use of California Air Resources Board Phase 3 gasoline during times when supplies of approved Arizona fuels are insufficient.

Implementation of the waiver may be conditioned on the director, after consulting with the Director of the Arizona Department of Agriculture and the Associate Director of the Weights and Measures Services Division, issuing a formal finding that a shortage exists in Arizona clean burning gasoline or Arizona reformulated blendstock for oxygenate blending supplies.
