SB 1339 Summary

• Requires all firearm sales or transfers to be conducted through a licensed firearms dealer, unless both parties are already licensed dealers.

• Mandates licensed dealers to conduct federal background checks on purchasers or transferees under 18 U.S.C. § 922(t) and state/local law before completing transfers.

• Allows dealers to charge a fee not exceeding $20 to cover administrative costs of facilitating private firearm transfers.

• Exempts law enforcement, military personnel, gunsmiths, common carriers, shooting range loans, lawful hunting/sporting loans, inherited firearms, antique firearms, and immediate family gifts from the transfer requirements.

• Classifies violations of the firearm sales and transfer requirements as a class 5 felony.
