HB 2104 Summary

• Prohibits import, sale, offer for sale, purchase, barter or possession with intent to sell of ivory, ivory products, rhinoceros horn, or rhinoceros horn products, with limited exceptions.

• Allows Arizona Game and Fish Department to issue permits for ivory and rhinoceros horn transactions only for bona fide educational or scientific purposes, unless prohibited by federal law.

• Permits conveyance of ivory and rhinoceros horn to legal beneficiaries as part of estate transfers or in anticipation of the owner's death.

• Establishes civil penalties of not less than $1,000 or twice the fair market value (whichever is greater) for violations; second or subsequent violations subject to not less than $5,000 or twice the value (whichever is greater).

• Requires courts to seize all ivory and rhinoceros horn products involved in violations and transfer them to Arizona Game and Fish Department for destruction or donation to educational or scientific institutions.
