HB 2131 Summary

• Amends Arizona Revised Statutes section 49-456 to remove the July 1, 2017 sunset date for the compliance advisory panel for small business air quality assistance programs.

• Modifies section 49-542 regarding vehicle emissions inspection programs, including technical changes to testing procedures (allowing steady state loaded tests, transient loaded tests, or opacity tests as alternatives to onboard diagnostic tests in certain circumstances).

• Changes the conditional enactment deadline in Laws 2014, chapter 89, section 6 from July 1, 2017 to July 1, 2020 for EPA approval of vehicle emissions testing program protocol modifications to become effective.

• Requires the director of the Department of Environmental Quality to notify the Arizona Legislative Council by September 1, 2020 regarding whether EPA approval of the emissions testing modifications was obtained.

• Makes the amendment to Laws 2014, chapter 89, section 6 retroactively applicable from June 30, 2017.
