HB2157 Summary

• Prohibits state and political subdivisions from denying reasonable access to private property.

• Allows owners of private property surrounded by state or publicly-owned land to request a nonexclusive right-of-way for at least 30 years to legally access their property.

• Requires state or political subdivisions to grant the requested right-of-way if it is necessary to provide legal access to the surrounded private property.

• State or political subdivision determines the location and width of the right-of-way following reasonable consultation with the property owner and may relocate it at their discretion.

• Exempts state from complying with environmental review requirements (sections 41-861, 41-862, 41-864) if the right-of-way has already been in use and no new road construction is necessary.
