HB 2221 Summary

• Prohibits municipalities from adopting codes or ordinances requiring home builders or developers to demonstrate that school districts have adequate facilities to accommodate new students or to donate money or property to school districts.

• Prohibits municipalities from denying rezoning requests, building permits, or other development approvals based on a developer's failure to make donations to or obtain certifications from school districts.

• Voids and declares unenforceable any contracts between school districts and home builders or developers relating to donations of money or personal property.

• Applies retroactively to September 30, 2000, addressing the practice of conditioning development approvals on school district donations.
