HB 2431 - Racing; Simulcasting Agreements

• Allows simulcasting of horse and dog races at additional wagering facilities without requiring consent from other commercial racing permittees after January 1, 2019.

• Requires that 20% of commission fees paid to dog racing permittees that operated in 2016 be distributed to the recognized horsemen's association when those permittees have simulcasting agreements with horse racing facilities in counties with populations over 3 million.

• Permits dark day simulcasting (wagering on simulcast races when no live racing occurs) for up to 20 days for horse and harness racing permittees in counties with populations between 700,000 and 1.5 million persons, with additional days allowed if permittees conduct a minimum of 140 live racing days.

• Allows advance deposit wagering providers to accept wagers on racing if approved by the state racing commission and with agreement from commercial live-racing permittees, with source market fees allocated similar to simulcast pari-mutuel wagering proceeds.

• Requires advance deposit wagering agreements between permittees to contain the same terms and conditions as simulcasting agreements for accepting horse racing wagers from counties with dog racing permittees.
