Bill Summary: HCR 2028

• Amends sections 9-833, 11-1603, and 41-1009 of Arizona Revised Statutes to establish inspection procedures and rights for regulated persons subject to municipal, county, and state agency inspections.

• Requires inspectors to present photo identification, state the inspection purpose and legal authority, disclose fees, and provide written notice of inspection and due process rights before or at initiation of inspections.

• Grants regulated persons the right to have an on-site representative present during inspections (except fire/life safety and food/pool inspections), obtain copies of documents and samples, and prohibits adverse treatment if the person is represented by an attorney.

• Establishes a "right to cure" allowing regulated persons 60 days to correct deficiencies identified in inspection reports, unless deficiencies are intentional, uncorrectable, constitute a pattern of noncompliance, or pose a risk to health and safety.

• Requires agencies to provide monthly updates on inspection-related actions and obtain the regulated person's signature acknowledging receipt of their rights; submits the measure to Arizona voters at the next general election.
