SB 1088 Summary

• Amends section 28-672 to add texting while driving as a moving violation that can result in serious physical injury or death charges, defined as operating a motor vehicle to manually type, send, read or enter written or visual communications including text messages, emails, or social media.

• Exception to texting prohibition applies to authorized emergency or law enforcement vehicles operated within the course and scope of official duties.

• Amends section 28-676 to add the same texting while driving violation as a predicate offense for the class 5 felony of causing serious physical injury by use of a vehicle.

• Defines "wireless communication device" to include wireless phones, text messaging devices, personal digital assistants, laptops and substantially similar removable devices used for manual text or data input.

• Excludes from the definition devices used for GPS/navigation, integrated vehicle systems, citizens band radios, and push-to-talk devices.
