SB 1134 Summary

• Requires any person residing in or outside Arizona who sells narcotics, controlled substances, prescription-only drugs, nonprescription drugs, precursor chemicals, or restricted chemicals within or into Arizona to hold a valid board-issued permit from the State Board of Pharmacy.

• Establishes civil penalties of up to $1,000 per violation for persons found after a formal hearing to be selling these substances or drugs without a valid permit.

• Authorizes the Board of Pharmacy to charge the cost of formal hearings to persons or their employees found in violation of pharmacy regulations.

• Grants the Board authority to inspect, investigate, send cease and desist letters, request conferences, or dismiss complaints regarding unauthorized drug or pharmaceutical sales activities.

• Requires the Board to issue a formal hearing notice under Arizona administrative law if a person refuses a conference invitation or fails to appear and investigation indicates grounds for civil penalty.
