SB1314 - Student Data Privacy

• Prohibits operators of school-focused websites, services, and applications from engaging in targeted advertising based on student data or using student information to create profiles for non-school purposes.

• Restricts sale or rental of student information, with limited exceptions for entity acquisitions, national assessment providers (with parental consent), and disclosures for employment, scholarships, or financial aid purposes.

• Requires operators to implement reasonable security procedures, delete student data upon school request unless parent/guardian consents to retention, and provide prominent notice before changing privacy policies.

• Allows operators to use student data for maintaining and improving their services, adaptive learning, research, legal compliance, safety, and responding to court orders, but prohibits further disclosure except to contracted service providers with strict restrictions.

• Exempts general audience websites and internet service providers from restrictions; establishes violations as unlawful practices enforceable by the Attorney General under state law.
