SB 1350 Summary

• Amends statutes to establish no statute of limitations for prosecutions involving violations of section 13-2308.01 (terrorism) and the new section 13-2308.03 (unlawful use of infectious biological substances or radiological agents).

• Creates new criminal offense of making a terrorist threat or knowingly making a false report of terrorism, classified as a class 3 felony, with persons liable for expenses incurred in responding to or investigating such threats or false reports.

• Establishes new offense of unlawful use of infectious biological substances or radiological agents as a class 2 felony, with specific prohibitions on possessing, manufacturing, distributing, or transporting such materials with intent to injure others or terrorize the public.

• Revises definitions in terrorism statutes to clarify that "terrorist organization" means only those designated by the U.S. Department of State as foreign terrorist organizations under federal law.

• Repeals former section 13-2925 and updates probation provisions to reference the new terrorism-related offenses created by this legislation.
