SB 1400 Summary

• Changes the delinquency threshold for HOA assessment lien foreclosure from one year or $1,000 to two years or $2,500, whichever occurs first.

• Requires associations to offer a reasonable payment plan for assessments, late charges, collection fees, and attorney fees, and to document that offer before foreclosing or collecting.

• Requires associations to offer a reasonable payment plan for other fees and charges before obtaining a judgment to collect them.

• Creates a new lien category for fees and charges other than assessments that can only be enforced after obtaining a judgment and recording it with the county recorder.

• Applies identical changes to both condominium associations (§33-1256) and planned community associations (§33-1807).
