AZ SB1401

Amends definitions in Arizona's condominium law (A.R.S. § 33-1202) to add "community management services" and "community manager" definitions.

Prohibits association employees, contractors, and community managers from soliciting, receiving or accepting undisclosed fees, compensation, commissions or gratuities from third parties providing goods or services to condominiums or planned communities.

Requires community managers to be familiar with condominium/planned community documents and applicable law, act in good faith with proper authorization, and comply with all governing documents and laws.

Creates liability for community managers who violate duties, allowing unit owners or members to bring damage actions and awards reasonable attorney fees and costs to the prevailing party.

Applies the same community manager restrictions and duties to planned communities under A.R.S. Title 33, Chapter 16 as established for condominiums.
