SB 1465 Summary

• Requires applicants for liquor licenses at premises within three miles of an Indian reservation to obtain approval from the tribal council or designated tribal governing body before the department may issue the license.

• Grants tribal councils and governing bodies of recognized Indian tribes the right to protest license applications and transfer applications in unincorporated areas within three miles of tribal land.

• Limits tribal protest rights to counties with populations of 200,000 or fewer persons and to applications for bar, beer and wine bar, liquor store, and beer and wine store licenses.

• Defines "Indian tribe" as any organized Indian nation, tribe or community recognized by the U.S. Department of the Interior and "tribal land" as trust lands held by the United States for exclusive Indian use.
