Allows merchants to offer suspects a precomplaint education program in lieu of filing a theft report with law enforcement, with merchants barred from receiving remuneration from educational providers or participants.

Requires merchants offering precomplaint education programs to provide written terms at time of offer, coordinate with local law enforcement and prosecutors, and provide notice to all local agencies before implementing the program.

Prohibits merchants from offering the program to persons previously convicted of shoplifting or previously offered such a program, and bars prosecution if a person successfully completes the program.

Requires merchants to offer the program to all qualifying persons regardless of age, gender, disability, race, color or religion, with fees reducible or waivable for persons below 200 percent of federal poverty guidelines.

Permits merchants to facilitate data sharing with law enforcement and provide identifying information on program participants to assist investigation and prosecution of criminal activity.
