HB 2190 Summary

• Amends definitions in Arizona Revised Statutes section 48-901 to clarify that "sewers" includes wastewater treatment facilities and "waterworks" includes drinking water treatment facilities.

• Expands section 48-909 to explicitly authorize county improvement districts to acquire, construct, reconstruct, and maintain drinking water treatment facilities and domestic water delivery systems both inside and outside district boundaries.

• Adds authority in section 48-909(E) allowing improvement districts formed for domestic water service to also provide domestic wastewater service if the county board of supervisors determines it serves the public interest.

• Authorizes county improvement districts in section 48-909.01 to borrow funds from the Water Infrastructure Finance Authority of Arizona and enter into financial assistance loan repayment agreements for wastewater treatment facilities, waterworks (including drinking water treatment), and sewer collection systems.

• Allows repayment of these loan agreements through assessments, revenue pledges, or combinations thereof, with districts having full authority to collect assessments and enforce delinquencies as if secured by bonds.
